Ordering Information, Terms of Sale, Warranty
Unless we otherwise agree in writing, the following terms are part of every order placed with MD Doctors Direct.
Orders
Orders may be placed by fax, phone, mail or email. All orders must contain a purchase order number, if available, and the name of the contact person for questions about the order. Unless other arrangements have been made in writing, all orders will be at MD Doctors Direct current prices. An order is not final until accepted by MD Doctors Direct. We supply professional healthcare workers and institutions such as doctors, hospitals, laboratories, pharmacies, drugstores and care facilities. We do not sell directly to private clients. Custom orders require separate treatment.

Price
All prices are F.O.B. Egg, Switzerland. The customer must pay all freight costs, as well as any sales, use, or other taxes on its order. MD Doctors Direct list prices are available on request. Prices are subject to change without notice. Freight charges may be taken by MD Doctors Direct according to its written offers and price lists.
Payment
Payment is due in advance for all orders. Approved accounts will receive payment terms of 30 days from date of invoice. If MD Doctors Direct must pursue collection of any amounts due to us, the customer will pay all costs of collection, including reasonable attorneys’ fees.
Freight
Because of the nature of MD Doctors Directs’ products, we are unable to ship to a home address or a P. 0. Box. MD Doctors Direct reserves the right to ship orders via the best method which will insure the stability of the product, minimize freight costs and allow efficient order tracking. MD Doctors Direct will use reasonable efforts to fill orders promptly.
Documents
It is the customer’s responsibility to notify MD Doctors Direct of all necessary documents or permits needed for customs clearance or other purposes.
Returns
All sales are considered final unless a return is warranted due to errors in filling the order by MD Doctors Direct, a product recall, or a product malfunction. We can only accept claims if they are made within 5 days after receipt of order. No returns can be accepted without prior approval by MD Doctors Direct and issuance of a return authorization number (RAM). Product must be received by MD Doctors Direct within three (3) days after return has been authorized.
Limited Warranty
MD Doctors Direct warrants, to the original purchaser only, that the products listed in the catalog and website are of the composition and purity described therein at the time that they are delivered to the purchaser and as described and warranted by the original manufacturer. Buyer’s exclusive remedy under this warranty is limited to replacement of unused product with product meeting the catalog description or, at MD Doctors Directs’ sole discretion, refund of the amount paid for the product. Purchaser must promptly report any warranty claims. Statements made about products by MD Doctors Directs’ sales persons or MD Doctors Directs’ distributors do not constitute warranties and should not be relied upon by buyer. MD DOCTORS DIRECT DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS EXCEPT THE EXPRESS WARRANTY CONTAINED IN THIS PARAGRAPH. THIS DISCLAIMER INCLUDES THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MD Doctors Direct shall not be liable for indirect, special or consequential damages resulting from use of the product.
Dispute Resolution
Each order is placed and accepted in Egg/ZH, Switzerland. Consequently, Swiss law applies to all transactions between the customer and MD Doctors Direct. Any dispute arising from, or relating to orders placed with, or filled by MD Doctors Direct that cannot be resolved through discussion between the parties (including any disputes regarding application of the Limited Warranty) must be resolved through binding arbitration under the auspices of the Zürich Commercial Court.
Conflict in Terms of Sale
Unless we have signed a written contract that modifies these Terms, the Terms contained in this document control all transactions between MD Doctors Direct and the customer, regardless of what any customer purchase order or other customer document may say.
